Your Voice
Your VoiceTM Online Panel ("Your Voice"), is owned and operated by ACNielsen Thailand 323 Silom Road, 26/F United Centre, 10500 Thailand. ("ACNielsen"). References to ACNielsen in these Terms and Conditions include ACNielsen's related bodies corporate.
General Conditions
y registering as a Your Voice Member ("Member") you are agreeing to these Terms and Conditions. ACNielsen reserves the right to amend or terminate these Terms and Conditions at any time without prior notice. Any amendments to these Terms and Conditions will be posted on the Your Voice website. Your use of the Your Voice website following the posting of any amendments shall constitute your acceptance of the amended Terms and Conditions.
Membership in the Your Voice Panel is open to residents of Thailand aged 18 and above. Only one account may be maintained per person. Multiple accounts may not use a single email address even if the accounts are for different people. ACNielsen reserves the right to close survey response periods early.
Confidentiality
Except as required by law, Members shall keep confidential and not disclose to any third parties the contents and any information associated with any surveys.
Personal Information
ACNielsen reserves the right to authenticate any information logged on the website, including registration details. It is the Member's responsibility to keep personal information as current as possible. ACNielsen adheres to Thailand's Privacy laws and Research Privacy Principles of ESOMAR. Please see the Privacy Statement for further information.
Member Account, Password and Security
You will receive a password and account designation upon completing the Your Voice Thailand registration process. You are responsible for maintaining the confidentiality of the password and account, and are fully responsible for all activities that occur under your password or account. You agree to (a) immediately notify Your Voice Thailand of any unauthorized use of your password or account or any other breach of security, and (b) ensure that you exit from your account at the end of each session. Your Voice Thailand and the ACNielsen group cannot and will not be liable for any loss or damage arising from your failure to comply with this Section.
Termination
ACNielsen reserves the right to terminate the membership and account of any Your Voice Member without prior notice and in ACNielsen's sole discretion. Circumstances in which a Member shall be terminated include but are not limited to (a) breaches or violations of the Terms and Conditions or other incorporated agreements or guidelines; (b) the existence of multiple accounts for the same Member; (c) lack of regular participation in the online surveys by a Member; (d) an invalid email address registered for an account; (e) a Member responds to emails or surveys that are intended for another person; (f) false or fraudulent responses or other fraudulent activity; (g) false referrals. ACNielsen may terminate or modify the Your Voice panel in its sole discretion. Termination for any reason will result in forfeiture of any accumulated e-points.
Exclusion of Liability
ACNielsen shall not be liable in contract, tort (including negligence) or otherwise for any direct or indirect, special, consequential or incidental damages or damages for loss of profits, loss of revenue, or loss of use, arising out of or in connection with the Your Voice website or its contents or any website accessed from the Your Voice website or any other ACNielsen website.
Indemnity
You will take all necessary action to defend and indemnify ACNielsen, its officers and employees against all costs, expenses and damages incurred in connection with any claim brought by a third party against ACNielsen arising from a breach by you of any of these terms and conditions or the Privacy Statement.

ACNielsen makes no warranties or representations about the accuracy or completeness of the content of this website or any site(s) linked to this site. ACNielsen is not liable or responsible for the content of any other websites, including any website through which you may have gained access to our website or to which you may gain access from our website. Legal Effect
If any provision of this notice shall be unlawful, void or unenforceable for any reason, then that provision shall be deemed severable to the extent that it is unlawful, void or enforceable, but shall not affect the validity and enforceability of the remaining provisions. Prize Draw Terms and Conditions
The Your Voice Prize Draw is open to Your Voice Thailand panel members only. Your Voice, an ACNielsen business, invites Thailand residents 18 years of age or above with principal residence in Thailand to join Your Voice Thailand as panel members. All members of the Your Voice Thailand panel are entered into the Prize Draw upon completing the registration survey. To apply for membership, a registration survey must be completed online at our website, +www.yourvoice.co.th Panel members also enter the draw each time they receive an email invitation from Your Voice and click through to the survey.
Information on how to enter and prizes form part of these conditions of entry.
Employees of ACNielsen, and the agencies and contractors of Your Voice associated with this promotion, and their respective immediate family members, are ineligible for participation. An "immediate family member" includes a spouse, child, parent, sibling, grandchild and grandparent.
Promotion commences 1 January 2008. Entries close at end of day 15 December 2008. The draw will take place at ACNielsen Thailand Limited, 26/F, United Center, 323 Silom Rd. Bangkok by end of business on the 15 July 2008 for the first round and on the <31/December/2008> on the second round. Winners will be notified by telephone and mail; as well as their names will be published on Your Voice Panel website. Promoter is not responsible for any prize notification that is returned as undeliverable or any telephone number which is incorrect or out of service, and in such event prize will be donated to Thai Red Cross Foundation. Judges' decisions are final and no correspondence will be entertained. ACNielsen Thailand Limited, in its sole discretion, reserves all rights to interpret and amend the Terms.
A total of 6 valid entries will be randomly drawn from among all entries by for a total prize value at approximately 20,000 baht. The prizes are: 2 units of iPod valued at approximately 8,000 baht. 4 units of Fuel coupon valued at approximately 1,000 baht.
Winners must claim their prizes by 15 August 2008 and 31 January 2009 for the first and second prize draw respectively, after which unclaimed prizes will be donated to Thailand Red Cross Foundation. Winners of prizes of more than 1,000 Baht in monetary value will be required to pay 5% withholding tax. Taxes on prizes are the sole responsibility of the winner.
Prizes are not transferable or exchangeable. No responsibility is accepted for any variation in the value of the prizes. No responsibility accepted for late, lost, illegible, incomplete or misdirected entries. Promoter reserves the right to change the prizes or substitute them with prizes of equivalent value.

How will we use the information you and other panelists provide us?
We use this information to perform market research, and to prepare reports and analyses. We may combine the data you provide us with research tools and information from other sources. Notwithstanding any other provision of this Notice, we also may disclose personally identifiable information to any third party when disclosure is required by law, or desirable to permit us to exercise our legal rights or take action regarding illegal activities or to protect the safety of any person. What information do we collect?
During the initial panel registration process or as part of a research survey, we request certain information such as name, address, telephone, email, birth date, gender, marital status, occupation, education level, and income. We also may (but may not) request more detailed demographic information such as race or ethnic group, religion, political views, and/or more detailed financial information. Once you have joined our panel, we will obtain additional information about you because we track a wide variety of information about preference and consumption behaviours and exposure to advertising. For example, depending upon the panels in which you participate, the information we collect may concern everyday personal and household products, video, television (cable, satellite or otherwise), radio, music, and reading material preferences and consumption, and location data. If you participate in a panel that involves healthcare information, we may collect certain health-related information about you including healthcare services received, prescriptions and over-the-counter medications used, the conditions for which these medications are used, and other pharmacy products that you purchase or use.
Cookies.
We use cookies, but only for limited and legitimate purposes. We use cookies for quality control and validation, to prevent bothersome repeat surveying, and to capture information about your browser type and software in order to deliver an interview best suited to your software. If you joined our panel via a web advert, we also may use a cookie to identify the site of the advert. We do not use any hidden identifier or spyware.
How do we collect personal information?
By participating on our panel, you specifically authorize us to accept preference and consumption information about you either directly from you or from outside sources, even if the collection or disclosure of such information otherwise would be inconsistent with those sources' privacy policies or obligations. Outside data sources may include, for example, the providers of the products and services you purchase or use, retail "loyalty" programs, and organizations that collect data online. We may periodically telephone you, and may periodically send you surveys or other correspondence and collect information from you via e-mail.
Your participation is always voluntary.
You may contact us if at any time you would like to see the information we hold about you, or to ask us to correct or update this information, or to ask us to delete all personal data that we hold about you, or to stop your participation in our panel.
About children.
Upon the panel or survey, the information we collect may include information about children. Before we collect information directly from a child, we try to verify that we have a parent's consent. We have certain measures in place for this purpose, but we cannot guarantee that these will always be successful.
Data security and transfer.
We may store your survey responses and the personal details we hold about you for as long as needed for the purposes indicated in this policy, which may be indefinitely. We may store this data in your home country, or we may transfer it to other countries. This data will be controlled by, and will be accessible electronically only to select members of the staff. We have in place certain security measures to protect personal data while controlled by us (for example, firewalls), but the storage and communication of personal data cannot always be completely secure.
